Conférence du Forum des juges de l'Union européenne pour l'environnement Conference of the European Union Forum of Judges for the Environment Cour de Cassation, Paris, 7-8 oct. 2008 Le Forum des juges de l'Union européenne pour l'environnement a tenu sa 5e conférence annuelle à Paris en octobre 2008 sur un thème à la fois sensible, complexe et essentiel en matière de protection de l'environnement : celui de la pollution des sols. Autour du projet de directive sol proposé par la Commission européenne en septembre 2006, cet ouvrage rassemble toutes les contributions qui ont alimenté la conférence. Outre la présentation détaillée, par le professeur Trébulle, des problématiques liées à l'état des sols, l'analyse des fonctions du sol et le point sur l'actualité du droit des pollutions par des praticiens spécialisés (Mme Rosengardten, juge à la cour d'appel chargée de l'environnement en Suède, Me Clément et Me Fourès, avocats à la cour d'appel de Paris, France), l'éclairage donné par la Commission européenne sur les objectifs poursuivis par la législation communautaire, et une description de l'état du droit français en la matière, il regroupe l'ensemble des réponses apportées par les juges des différents États participants à un questionnaire qui a constitué la base des discussions. Axés sur l'analyse de cas pratiques, les travaux de la conférence sont repris dans une note de synthèse et soulignent le rôle essentiel du juge dans la mise en oeuvre effective du droit de l'environnement. Dans une perspective de droit comparé autour de la mise en oeuvre du droit communautaire, cet ouvrage est, outre un élément de réflexion générale, un outil supplémentaire proposé par le Forum à tous les juristes ayant à connaître de ces questions.Créé le 28 février 2004 à l'initiative de hauts magistrats - Guy Canivet (France), Amedeo Postiglione (Italie), Luc Lavrysen ( Belgique), actuellement président, et Lord Carnwath (Royaume Uni) -, l'EUFJE est une organisation internationale non gouvernementale ouverte à tous les juges de l'Union européenne et de l'Association européenne de libre échange. Il a pour objet de contribuer à la mise en oeuvre du droit de l'environnement national, européen et international par l'amélioration des connaissances des juges en droit de l'environnement, par l'échange de données jurisprudentielles et le partage des expériences en matière de formation au droit de l'environnement.******The European Union Forum of Judges for the Environment (EUFJE) has organised its fifth yearly conference in Paris in October 2008 on a subject that is at the same time sensible, complex and essential in environmental protection: the pollution of soils. Built around the proposal for a directive of the European Commission of September 2006, this book brings together all the contributions of the conference. Besides a detailed contribution by professor Trébulle of the problems connected with the state of the soils and the functions of it, it contains presentations of the actual legal situation by specialised practitioners (Ms. Rosengardten, judge with the Swedish Environmental Court of Appeal, Mr. Clément en Ms. Fourès, advocates with the Court of Appeal of Paris), an introduction by the European Commission of the objectives of the European legislation, a description of the relevant French legislation, and all the answers provided by judges of the large majority of the Member States of the EU to a questionnaire that constituted the basis of the discussions. Tailored on the analysis of practical cases, the proceedings of the conferences are contained in a general report that highlights the essential role of judges in the effective implementation of Environmental law.
